These terms cover your use of this website and the practical policies that apply when you book tattoo work with Broken Heart Tattoo San Diego.
Using this website
This website is provided by Broken Heart Tattoo San Diego for information purposes. By using it you accept these terms. If you do not accept them, please do not use the site.
The content on this site - text, photography, designs and the studio's branding - belongs to Broken Heart Tattoo San Diego or is used with permission. You may not copy, reproduce or use it commercially without our written consent. You are welcome to link to any page on this site.
We aim to keep the information here accurate and current, including opening hours, pricing guidance and availability. Tattoo pricing in particular depends on size, detail, placement and artist, so the figures described on this site are guidance rather than a quotation. The price we confirm at your consultation is the price that applies.
Consultations
Consultations are free and last about 15 minutes. There is no obligation to book. You can book one through the Book Now page, by phone on (619) 237-0058, or by email at brokenhearttattoo.CS@gmail.com.
At the consultation we discuss your concept, placement, size and the artist best suited to the work, and give you a firm price, a deposit amount, and an estimate of how many sessions the piece will need.
Age requirement
You must be at least 18 years old to be tattooed. California law does not permit tattooing a minor, even with parental consent. We require valid government-issued photo identification showing your date of birth on the day of your appointment. We cannot proceed without it, and there are no exceptions.
Deposits and booking
- A deposit is required to secure a booked session. The exact amount is confirmed at your consultation before you commit.
- The deposit is applied to the final price of your tattoo. It is not an additional charge.
- Deposits are non-refundable, because booking a session reserves that time and the artist's preparation for it.
- Deposits are transferable to a rescheduled session, provided you give us reasonable notice as set out below.
Rescheduling, cancellation and no-shows
- Rescheduling: contact us as early as you can. With reasonable notice your deposit moves to the new date at no cost.
- Late cancellation or no-show: if you cancel with little or no notice, or do not attend, your deposit may be forfeited and a new deposit required to rebook.
- Repeated rescheduling: if a booking is rescheduled repeatedly, we may treat it as a cancellation.
- Our cancellations: if we have to cancel or move your appointment for reasons within our control, your deposit transfers or is refunded in full, at your choice.
Preparing for your appointment
Come in having eaten properly and having drunk water. Do not drink alcohol or take blood-thinning medication in the 24 hours before your session - alcohol increases bleeding, which affects how the tattoo heals and how the ink settles. Please avoid intense sun exposure on the area in the days beforehand. Tell us about any medical condition, medication or allergy that could affect the process.
If you arrive under the influence of alcohol or drugs, we will not proceed with the tattoo and your deposit may be retained.
Designs and ownership
Custom designs created by our artists remain the intellectual property of the artist and the studio. We may photograph and display finished work, including in our portfolio and on social media, unless you ask us not to in writing.
We reserve the right to decline any design or request. We will not tattoo content that is hateful, discriminatory, or that we believe is intended to harm others, and we will not copy another artist's custom work at a client's request.
Aftercare is your responsibility
We give you written aftercare instructions after your session and will explain them before you leave. How a tattoo heals depends substantially on how you care for it. Following aftercare properly, and protecting the tattoo from sun exposure, is your responsibility.
We are glad to assess a healed tattoo and touch up our own work where it is needed. This does not extend to damage caused by poor aftercare, sun exposure, or work that was done by another studio.
Health, safety and disclosure
Tattooing involves breaking the skin with sterile, single-use equipment. You must tell us before your appointment about any condition that could affect the process or your healing - including pregnancy, diabetes, heart conditions, blood disorders, skin conditions such as eczema or psoriasis in the area to be tattooed, and any medication that thins the blood or suppresses the immune system.
We may decline to tattoo you if we believe it would be unsafe. This is a safety decision, not a judgement about you.
Payments
We accept Cash, Credit Card, Zelle. The final balance is due on completion of each session unless we agree otherwise in advance. Please ask before your appointment if you plan to pay by a method that is not listed.
Third-party services on this site
This site embeds or links to services run by other companies, including Calendly for booking, Google for analytics and maps, and Yelp, Instagram and Facebook for our public profiles. Those services have their own terms and privacy policies, which apply when you use them. We are not responsible for their content or availability. See our Privacy Policy for details.
Limitation of liability
This website is provided on an "as is" basis. We work to keep it accurate and available but do not warrant that it will be error-free or uninterrupted. To the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this website. Nothing in these terms limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of California, United States. Any dispute is subject to the exclusive jurisdiction of the courts of California.
Changes to these terms
We may update these terms from time to time. The version published on this page at the time of your booking is the version that applies to that booking.
